Terms of Service

1. Nature of the Platform

BaryoHub is a technology platform that facilitates the digital submission, processing, tracking, and verification of barangay-related documents.

BaryoHub does not:

• Act as a government authority
• Approve or deny applications
• Issue official certificates
• Replace the discretion of barangay officials

All approvals, denials, and issuances are performed solely by the participating barangay. BaryoHub operates strictly as a Software-as-a-Service (SaaS) provider to local government units.

2. Eligibility

By using the platform, you represent that:

• You are at least 18 years old, or supervised by a legal guardian
• You possess legal capacity under Philippine law
• All submitted information is truthful and accurate

Submitting falsified documents may expose you to criminal liability under the Revised Penal Code (Falsification), Cybercrime Prevention Act, and E-Commerce Act.

3. Account Responsibility

You are solely responsible for:

• Maintaining password confidentiality
• All activities under your account
• Securing your devices

BaryoHub shall not be liable for damages resulting from compromised credentials caused by user negligence.

4. Government Relationship Disclosure

Barangays using BaryoHub are independent government entities. Nothing in these Terms shall be interpreted as creating an agency, partnership, or joint venture between BaryoHub and any government unit.

Each barangay is solely responsible for:

• Document legitimacy
• Approval decisions
• Compliance with government regulations

5. Electronic Documents, QR Codes, and Digital Signatures

In accordance with Republic Act 8792 (E-Commerce Act), documents issued through BaryoHub may include electronic signatures, cryptographic hashes, QR-based verification, and digital seals.

When verified through the official validation portal, such documents are considered digitally authentic. However, acceptance of digital documents remains at the discretion of the requesting institution. BaryoHub does not guarantee third-party acceptance.

6. Acceptable Use

You agree not to:

• Submit fake identities or forged documents
• Manipulate verification systems
• Attempt unauthorized system access
• Conduct denial-of-service attacks
• Reverse engineer the platform
• Use automation to overload services
• Resell access without authorization

We reserve the right to suspend accounts, permanently ban users, and report violations to authorities without prior notice.

7. Fees and Payments

Fees displayed may include:

• Barangay-imposed charges
• Convenience fees
• Payment processing fees

Payments are generally non-refundable once processing begins. BaryoHub is not responsible for disputes involving barangay pricing, refund approvals, or government fees.

8. Data Privacy

Your data is processed in compliance with the Data Privacy Act of 2012. By using BaryoHub, you consent to the collection and processing of personal data necessary to deliver the service. Please refer to our Privacy Policy for full details.

9. Platform Availability

We strive for high reliability but do not guarantee uninterrupted service. BaryoHub shall not be liable for failures caused by:

• Natural disasters
• Power outages
• Cyberattacks
• Telecom failures
• Government system downtime
• Force majeure events

10. Limitation of Liability

To the fullest extent permitted by law, Digital Horizon Solutions Inc. shall not be liable for any indirect damages, loss of income, lost opportunities, application rejections, government decisions, fraud committed by users, or unauthorized access beyond reasonable security controls.

The total liability of Digital Horizon Solutions Inc. shall not exceed the amount paid by the user to the platform within the preceding twelve (12) months.

11. Indemnification

You agree to defend, indemnify, and hold harmless Digital Horizon Solutions Inc. from any claims, damages, or legal actions arising from:

• Fraudulent submissions
• Misuse of the platform
• Violations of law
• Intellectual property infringement
• False representations

12. Intellectual Property

All rights, title, and interest in BaryoHub — including software, workflows, branding, UI/UX, and infrastructure — remain the exclusive property of Digital Horizon Solutions Inc. Unauthorized copying or replication is strictly prohibited.

13. Third-Party Integrations

The platform may rely on third-party providers such as payment processors, cloud infrastructure, SMS/email gateways, and identity verification services. We are not liable for outages or failures originating from these providers.

14. Right to Suspend Service

We reserve the right to immediately suspend access if necessary to protect platform security, prevent fraud, comply with law, or respond to government orders. No liability shall arise from such suspension.

15. Arbitration Clause

Before filing any court action, parties agree to attempt resolution through good-faith negotiation. Disputes shall first be resolved through binding arbitration in the Philippines before resorting to courts.

16. Updates to Terms

We may modify these Terms at any time. Continued use of BaryoHub constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by the laws of the Republic of the Philippines. Venue for disputes shall be the proper courts of Panglao, Bohol.
